These Terms of Service (“Terms”) govern your access to and use of the Bommol website and platform (the “Service”), provided by [Bommol legal entity name] (registration number [●]) (“Bommol”, “we”, “us”). By using the Service you agree to these Terms. If you are using the Service on behalf of a business, you confirm you are authorised to bind that business.
1. The Service
Bommol is a business management platform that may include accounting, payroll, point of sale, stock, e-commerce and related modules. We grant you a non-exclusive, non-transferable right to use the Service for your internal business purposes, subject to these Terms and your subscription.
2. Accounts and responsibilities
- You are responsible for your account, your users, and keeping login credentials secure;
- You are responsible for the accuracy and legality of the data you put into the Service;
- You must comply with applicable laws, including tax, payroll and data-protection laws, when using the Service.
3. Fees and payment
Access to paid features is subject to the fees and billing cycle agreed for your subscription. Fees are payable in advance unless agreed otherwise, and are non-refundable except where required by law. We may change fees on reasonable notice.
4. Your data and ownership
You retain all rights in the data you enter into the Service (“Your Data”). You grant us the limited rights needed to host and process Your Data to provide the Service. We process personal information in Your Data as described in our Privacy Policy. You can export Your Data from the Service.
5. Acceptable use
You agree not to misuse the Service, including by attempting to breach its security, reverse-engineer it, resell it without authorisation, upload unlawful content, or interfere with its operation or other users.
6. Availability and support
We aim to keep the Service available and to provide support as described in your plan, but the Service is provided on an “as available” basis. We may perform maintenance and may modify or discontinue features, giving reasonable notice of material changes where practical.
7. Warranties and disclaimers
The Service is provided “as is”. To the extent permitted by law, we disclaim implied warranties. Bommol assists with record-keeping and calculations but does not provide accounting, tax, legal or financial advice; you remain responsible for your own compliance and figures.
8. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential loss, and our total liability arising out of or relating to the Service is limited to the fees you paid for the Service in the [12] months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.
9. Indemnity
You agree to indemnify us against claims arising from your unlawful use of the Service or breach of these Terms.
10. Term and termination
These Terms apply while you use the Service. Either party may terminate as set out in your subscription. On termination, your right to use the Service ends, and you may export Your Data within a reasonable period, after which we may delete it in line with our retention practices.
11. Confidentiality
Each party will protect the other’s confidential information and use it only as needed to perform under these Terms.
12. Governing law
These Terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and change the “last updated” date above. Continued use of the Service after changes means you accept the updated Terms.
